What is a Personal Injury Case and What Should You Look-Out For? by Corey Walker

For more than 100 years Iowa Courts have recognized a person’s right to bring a claim against another for injuries caused by fault, also known as negligence. Whenever you are hurt by anyone’s negligence, including that of another car driver, corporation, manufacturer, store merchant, or someone else you have a “personal injury” claim. Car and motorcycle accidents (injuries caused by a negligent driver), dog bites (injuries caused by a dog or other animal), falls (injury because someone did not take care of the walkway for example), nursing home (injuries sustained by a resident of a nursing home) and product liability (injury by harmful product) are all subtypes of personal injury cases.

However, if your injury happened while you were working (what is known as a workers’ compensation case) special laws apply. For example, in a workers’ compensation case the employee does not have to prove fault or negligence like they would in a car accident or personal injury case. However, the trade-off is that the employee’s damages are limited. In an Iowa workers’ compensation case, an employee is generally not allowed to recover pain and suffering or loss of quality of life damages against the employer. The exception to this rule is if you can prove that a co-employee committed “gross negligence”. Also, if you were injured by someone who does not work for your employer or a defective product caused your injuries then you may be entitled to additional damages. You should consult an attorney to find-out if your case meets one of these criteria.

Regardless of the type of case that you have, one misconception is that the insurance adjustor is there to help you with your injury case. The insurance adjustor works for the other side and has no duty to protect your rights or even tell you what the law is. Just because you are reasonable with the insurance adjustor does not mean that the insurance adjustor will be reasonable with you. Remember, insurance companies would rather collect premiums than pay claims so they train their adjustor to pay you as little as possible. Sometimes this means intentionally frustrating you in hopes that you will give-up and go-away. If you decide to try to handle your case on your own, it is important that you do not lose your temper or make threats to the insurance adjustor. If the adjuster makes a ridiculously low offer, it may be difficult not to show emotion. However, getting angry will not convince the carrier to offer more money. In the eyes of the adjustor it means that you have a short temper which will certainly not help your case.

Often when you have been injured the insurance adjustor will ask you to provide a recorded statement. Sometimes, they will even tell you that you must give them a recorded statement before they will consider your claim. While this can be true if you are making a claim against your own insurance company, for example in a property damage claim, uninsured or underinsured motorist claim, you are generally not required to give a recorded statement to the insurance adjustor for the other party. The reason that they want the recorded statement is so that they can ask you questions before you are prepared to answer them. For example, the adjustor may ask you “Have you ever had neck pain before?” Your immediate response may be “No”. Well, if you previously saw your family doctor or a chiropractor at sometime in your life and mentioned neck pain this can create a real problem because your credibility is very important

SOME have lost millions in bank shares. Others have seen their pensions completely wiped out. Many have had their houses repossessed. Even more have had to finally pony up for the egregious loans they so casually invited on to themselves. But you won’t find them sitting whey-faced in the Berkeley Court, drinking a brandy and Gaviscon, because unlike others, when faced with disaster, the Irishman leans into the wind and tries to hold his pint steady.

In the face of disaster, why some kind of extraordinary self-hypnosis takes over is a mystery, but despite the horrors that surround him, he convinces himself that in the end, everything will be ‘grand’.

Wouldn’t you think that, given the financial apocalypse, the plummeting property prices, the floods in Cork and Galway and the recent disaster of the countrywide big freeze, with roads impassable, public transport at a halt and schools closed, that what we need is a snap of the fingers to bring us out of our hypnotic stupor.

Chronic obstructive pulmonary disease sent about 18 percent more Pennsylvania residents to hospitals in 2008 than it did four years earlier, according to a report released today by an agency that monitors the state’s health-care spending.

The disease, known as COPD, was one of four the Pennsylvania Health Care Costs Containment Council studied. It found smaller increases in hospitalization rates for diabetes and asthma. The number of people hospitalized with heart failure declined 16 percent between 2004 and 2008.

The state’s aging population and high number of smokers could contribute to the increases, experts said.

“Smoking is the leading condition that contributes to COPD, and secondhand smoke for children can lead to asthma,” said Leslie Best, director of the Bureau of Health Promotion and Risk Reduction for the Pennsylvania Department of Health. “For diabetics, tobacco use is a large risk factor.”

Hospitalizations for heart failure decreased in part because of improvements in therapy, better clinical care guidelines and increased awareness, said Stephanie Suran, spokeswoman for the council.

Financial bonuses offered by insurance companies including Highmark encourage hospitals to prevent re-admissions for heart failure, said Mary Goessler, Highmark’s medical director for quality and medical performance management.

Real-estate chiefs want banks to ease up on their conservative lending, as farm sales remain slow in Canterbury at one- quarter of their total two years ago.

The 27 sales in the three months ending March put the province second behind Waikato for the most properties traded in New Zealand, but the market is sluggish and well back on the 105 farms sold in 2008.

Dairy-farm values have fallen more than 20 per cent nationally from a high of $60,000 a hectare in isolated cases in the pre- recession boom, and there should, in theory, be buying opportunities with low interest rates and a good milk payout.

Real Estate Institute of New Zealand (REINZ) president Peter McDonald said the institute was concerned that New Zealand farmers were losing out to overseas investors, because local lenders were being too cautious.

He said dairy returns were good, with the prospects looking better next season and there were opportunities for people to develop their businesses, as Chinese investors had observed.

“My concern is we have an almost standstill industry in sales, but a lot of people want to buy. Bring a buyer who has $1.5 billion (into the market), and there is not a lot of opportunities for our guys.

“Most people are concerned about that sort of investment in our farming, because we are farmers.”

Hong Kong-listed Natural Dairy New Zealand is seeking approval to buy 29 North Island farms, formerly part of the Crafar family’s estate, and farms in the South Island.

McDonald said few dairy farms were turning over during the prime selling period, and runoff blocks and grazing properties were not selling particularly well.

He said it would be a shame to have to rely on Chinese investors to kick-start the market again

NICK had no idea he had become a victim of identity fraud until he applied for a mortgage.

His application was declined on the basis that he had defaulted on repayments of a Pounds 12,000 loan and a credit card with a Pounds 5,000 limit.

Unbeknown to the 32-year-old teacher, someone had stolen his name, address and personal details to obtain the loan and cards nine months earlier.

He has no idea how it happened and the offender was never traced.

But the repercussions were enor mous.

As well as the threat to the victim’s credit rating, it is time- consuming and frustrating to resolve. It took Nick four months to sort out the problem, thwarted by security measures designed to protect the customer.

When he rang the credit card company, he was barred from obtaining information because he didn’t have the account’s security password.

Nick turned to friend Charlie Scott, hoping his experience in financial services could help him unravel the mess. But there was worse to come. Mr Scott said: “He checked his credit report six months later and found it had happened again. This time, two credit cards had been taken out in his name.
